The Sub-Committee resolved that under Section 100A(4) of the Local Government Act 1972  the press and public be excluded from the meeting for this item of business on the grounds that their presence would involve the likely disclosure of exempt information as described in Paragraph 3 of  Part 1 of Schedule 12A of the Act.

The Principal Lead Officer, Business Regulation Team had submitted a report to inform the determination of the applicant’s suitability to continue to operate a street trading business.

The General Purposes Licensing Casework Sub-Committee resolved to:

  • Suspend the applicant’s Street Trading Consent, until such time that he has demonstrated either that the Traffic Commissioner has granted a stay of the suspension of the HGVOL or that he has a valid HGVOL. This decision was made taking into account the details set out in the report and the representations made at this Sub-Committee meeting.

Exempt Matters and Confidential Session

If the Sub-Committee wishes to exclude the press and the public from the meeting during consideration of any aspects of the preceding or following agenda items it will be necessary for the Sub-Committee to pass a resolution in accordance with the provisions of Section 100A(4) of the Local Government Act 1972 specifying the grounds on which their presence could involve the likely disclosure of exempt information as described in specific paragraphs of Part 1 of Schedule 12A of the Act if and so long, as in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

Minutes:

The Sub-Committee resolved that under Section 100A(4) of the Local Government Act 1972  the press and public be excluded from the meeting for the remaining items of business on the grounds that their presence would involve the likely disclosure of exempt information as described in Paragraph 3 of  Part 1 of Schedule 12A of the Act.

The Sub-Committee considered matters relating to Hackney Carriage and Private Hire Vehicle licensing in private.

Suitability to continue to drive Private Hire Vehicles

To consider the confidential report and reach a decision.

Minutes:

The Executive Director for Communities and People had submitted a report to inform the determination of the appellant’s 'fit and proper' status to continue to drive Private Hire Vehicles in the City.

The General Purposes Licensing Casework Sub-Committee resolved to:

 

  • Revoke the appellant’s Private Hire Driver Licence taking into account the details set out in the report and the representations made at this Sub-Committee meeting.

Suitability to continue to drive Hackney Carriage & Private Hire Vehicles

To consider the confidential report and make a decision.

Minutes:

The Executive Director for Communities and People had submitted a report to inform the determination of the appellant’s ‘fit and proper’ status to renew his licence to drive Hackney Carriage & Private Hire Vehicles in the City.

 

The General Purposes Licensing Casework Sub-Committee resolved to:

 

  • Grant the appellant’s Private Hire Driver Licence taking into account the details set out in the report and the representations made at this Sub-Committee meeting. The license was granted with the condition that if there are any other complaints, major or minor, in the next 12 months the appellant will be required to come straight back to the committee for reconsideration of his fit and proper person status.

 

This decision was not unanimous, one member of the Sub-Committee did not agree with the decision reached. 

 

50.

Suitability to continue to drive Private Hire Vehicles

To consider the confidential report and make a decision.

Minutes:

The Executive Director for Communities and People had submitted a report to inform the determination of the appellant’s ‘fit and proper’ status to continue to drive Private Hire Vehicles in the City.

The General Purposes Licensing Casework Sub-Committee resolved to:

 

  • Take no action regarding the appellant’s Private Hire Driver Licence and to allow it to continue until it’s expiry in January of 2027. This decision was reached by taking into account the details set out in the report and the representations made at this Sub-Committee meeting. The license was allowed to continue with the condition that if there are any other complaints, major or minor, in the next 12 months the appellant will be required to come straight back to the committee for reconsideration of his fit and proper person status.
