Oxford Burial Meadow – Partial Surrender of Oxford City Athletic Club Tenancy

Decision Maker: Deputy Chief Executive – Place

Decision status: Recommendations Approved

Is Key decision?: No

Is subject to call in?: No

Purpose:

The decision will achieve the partial surrender of part of the Oxford City Athletic Club tenancy that will return control of the land back to Oxford City Council. This will in turn, subject to planning consent being obtained, allow the creation of an accessway from the existing Oxford City Council owned public carpark to the site of the proposed burial meadow to be developed on the land owned by Oxford City Council.

Decision:

To enter into a Deed of Partial Surrender of Lease with the Oxford City Athletic Club CIC for the surrender of part of their tenancy to Oxford City Council.

Reasons for the decision:

Accepting partial surrender of the tenancy gives Oxford City Council vacant possession of land that will help enable the Oxford Burial Meadow project to proceed once planning consent has been obtained.

Oxford City Council are to accept partial surrender of the land in advance of planning consent being determined.

Alternative options considered:

Not taking a surrender of part of the Oxford City Athletic Club’s tenancy would result in the Council not being able to create an accessway from the existing Oxford City Council owned public car park to the land where the proposed burial meadow is to be developed.
