The Head of Law and Governance has submitted a report which reports the Council’s application of its powers under the Regulation of Investigatory Powers Act 2000 

 

Officer recommendation: That Council note the Council’s use of its powers under the Regulation of Investigatory Powers Act 2000 (RIPA) for the period 1 April 2014 to 31March 2015.

Minutes:

Council had before it a report detailing the Council’s application of its powers under the Regulation of Investigatory Powers Act 2000.

 

Councillor Price moved the recommendation in the report, and this was agreed on being seconded and put to the vote.

 

Council resolved to note the Council’s use of its powers under the Regulation of Investigatory Powers Act 2000 (RIPA) for the period 1 April 2014 to 31 March 2015.

The Head of Law and Governance has submitted a report which details the Council’s application of its powers under the Regulation of Investigatory Powers Act 2000.

 

Council is asked to note the use of the powers under the Regulation of Investigatory Powers Act 2000 (RIPA) for the period 1st April 2012 to 31st March 2013 and to note the recent amendments to RIPA relating to judicial approval and custody thresholds.

The Head of Law and Governance submitted a report (previously circulated, now appended) which detailed the Council’s application of its powers under the Regulation of Investigatory Powers Act 2000.

 

Councillor Bob Price, seconded by Councillor Ed Turner, moved and spoke to the report.

 

Council agreed to note the use of the powers under the Regulation of Investigatory Powers Act 2000 (RIPA) for the period 1st April 2012 to 31st March 2013 and to note the recent amendments to RIPA relating to judicial approval and custody thresholds.

This report proposes changes to the Council’s Regulation of Investigatory Powers Act procedure.  The recommendations for change, following the annual external inspection of policies and procedures, are set out in paragraph 2 and the revised procedure takes these recommendations on board.

Resolved to:-

 

(1)    Approve the appointment of the Head of Law and Governance as the Council’s Senior Responsible Officer for the purposes of the regulation of investigatory powers under the Regulation of Investigatory Powers Act;

 

(2)    Authorise the Head of Law and Governance to appoint a co-ordinating officer for the purposes of the regulation of investigatory powers under the Regulation of Investigatory Powers Act;

 

(3)    Note the Council’s amended Regulation of Investigatory Powers policy document as set out in the Appendix to the report.
