Minutes:

Cllr Royce declared an interest in items 7 and 8 (minutes 81 and 82) she left the room whilst these cases were determined.

79.

Exempt Matters

If the Sub-Committee wishes to exclude the press and the public from the meeting during consideration of any aspects of the preceding or following agenda items it will be necessary for the Sub-Committee to pass a resolution in accordance with the provisions of Section 100A(4) of the Local Government Act 1972 specifying the grounds on which their presence could involve the likely disclosure of exempt information as described in specific paragraphs of Part 1 of Schedule 12A of the Act if and so long, as in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

Minutes:

The Sub-Committee resolved that under Section 100A(4) of the Local Government Act 1972  the press and public be excluded from the meeting for the remaining items of business on the grounds that their presence would involve the likely disclosure of exempt information as described in Paragraph 3 of  Part 1 of Schedule 12A of the Act.

 

The Sub-Committee considered matters relating to Hackney Carriage and Private Hire Vehicle licensing in private.

 

The Sub-Committee had 4 cases before it, the following decisions were made:

·         The original Sub-Committee decision was rescinded and the driver can continue to drive a Private Hire vehicle.

·         No further action will be taken, and the driver can continue to drive a Hackney Carriage and Private Hire vehicle.

·         The case was deferred to allow the driver’s legal representation to attend.

·         The Hackney Carriage and Private Hire vehicle licence was revoked.

Suitability to continue to drive Hackney Carriage and Private Hire Vehicles and hold a Private Hire Vehicle Licence in light of a Caution

Report of the Head of Environmental Development attached.

Minutes:

The Sub-Committee resolved to RESCIND the original revocation decision of the driver’s licence made on 29 July 2014. The driver’s Hackney Carriage and Private Hire vehicle licence was re-instated.

Suitability to continue to drive Private Hire vehicles in light of a Caution

The Sub-Committee resolved that the driver can continue to drive a Hackney Carriage and Private Hire vehicle.

Suitability to continue to drive Hackney Carriage and Private Hire Vehicles in light of recent convictions

Minutes:

This case was DEFERRED on the request of the licence holder’s legal representative.

 

84.

Suitability to continue to drive Private Hire Vehicles in light of recent convictions

The Sub Committee resolved to REVOKE the licence holder’s Private Hire vehicle licence in light of a recent conviction.
